  1. About us
    • 1.1

      Welcome to e-TC (Website). The Website is operated by the University of Sydney (ABN 15 211 513 464) acting through and represented by its Psycho-oncology Co-operative Research Group (we, us or our).

    • 1.2

      Your access to and use of the Website is subject to these terms of use (Terms). By registering to use the Website, you will be agreeing to be bound by these Terms.

  2. About you
    • 2.1

      e-TC has gathered information and resources that relate to the reduction of anxiety and depression in survivors of testicular cancer.

    • 2.2

      The Website is intended as a general introduction to the types of emotional responses that can occur in the context of testicular cancer survival. This is intended as general information only and is not tailored to the symptoms suffered by any single person.

    • 2.3

      The e-TC platform may not be appropriate for you if:

      1. you have not experienced testicular cancer;
      2. you are not currently cancer-free;
      3. you are in a crisis situation;
      4. your personal safety is at risk; or
      5. you require specialised medical treatment.
    • 2.4

      Whilst there are benefits to mental health information being made available online, the Website is not intended to replace traditional forms of face-to-face therapy. We encourage you to seek the services of a mental health professional if you think you may need to do so. Hopefully our Website will help you to understand your emotional responses and give you the confidence to seek further help if you need it.

    • 2.5

      If you would like to understand whether you might meet the diagnosis of a mental health condition, you will need to seek a diagnosis from a qualified mental health professional. The online psychological assessments completed as part of the Website are for research purposes only and cannot be used to diagnose any medical or mental health condition.

  3. Registration and access
    • 3.1

      You must register and obtain a password before you are permitted to use the Website. We can decline registration of any person in our sole discretion.

    • 3.2

      You represent and warrant to us that:

      1. you are over 18 and otherwise have the legal capacity to enter these Terms;
      2. you live in Australia; and
      3. you have submitted full, truthful and up to date personal information in the user registration process.
    • 3.3

      You must protect your account information, including your password. All activity on the Website that occurs under your login is your responsibility and we may treat it as having been done by you. You must notify us immediately if there is any unauthorised use of your login.

    • 3.4

      We do not represent or warrant that the Website complies with the laws of any country outside of Australia. If you access and use the Website from outside Australia, you do so at your own risk.

  4. Registration and access
    • 4.1

      The Website is supplied solely for non-commercial, personal use.

    • 4.2

      You may download and print individual measures from the Website for your own personal, non-commercial use in the normal course of using the Website.

    • 4.3

      You must not use or attempt to use the Website except as expressly authorised by us or these Terms, permitted under the Copyright Act 1968 (Cth) or under other applicable laws. Without limiting this, you must not:

      1. adapt, reproduce, copy, store, transmit, communicate to the public, distribute, publish or create derivative works from any part of the Website;
      2. use any of the Website for commercial purposes or commercial gain or to establish, operate or maintain your own product or service offering;
      3. whether through the use of additional software or otherwise, data mine or conduct automated searches of the Website;
      4. incorporate any of the Website’s content with any other material, including advertising and promotional material;
      5. create links to the Website from any other website or frame or mirror the Website;
      6. use the login of another user or otherwise attempt to access or use their account without authorisation from that user and us;
      7. tamper with, hinder the operation of or make any modifications to the Website;
      8. knowingly transmit any virus, worm, trojan horse or other disabling feature to or via the Website; or
      9. attempt to do, or permit any other person to do, any of the above acts.
  5. Intellectual property
    • 5.1

      All intellectual property rights comprised in the Website (including the software, design, text, data, icons, logos, sound recordings and graphics comprised in the Website and the layout of the Website) are owned by us and/or our licensors. Nothing in these Terms constitutes a transfer of ownership of any intellectual property rights.

    • 5.2

      We grant you a non-exclusive, worldwide, non-transferable limited licence to use the Website in accordance with these Terms.

    • 5.3

      We may provide links to a number of external websites via the Website. Monitoring and reviewing content of these external websites is not our responsibility nor do we necessarily endorse, approve or recommend their content, owners or operators.

    • 5.4

      We are committed to upholding the rights of copyright owners. If you believe that copyright material is available on the Website in such a way that it constitutes a copyright infringement or a breach of a contract or licence, please notify our Designated Representative using the Copyright Takedown Notice.

  6. No warranty
    • 6.1

      We have taken reasonable care in compiling the Website. However, the Website is provided 'as is' and we do not warrant or represent that it is complete, current or free from errors or omissions.

    • 6.2

      The availability of our services and access to the Website may be interfered with by numerous factors, including those outside our control (such as malfunction in equipment or software, Internet access difficulties, or delay or failure of transmission). Accordingly, we do not warrant or represent that our services and/or your access to the Website will be continuous, uninterrupted, timely, free from errors, faults or viruses, or secure.

  7. Liability
    • 7.1

      The Website is being provided free of charge to you and as such you use it at your own risk.

    • 7.2

      We accept no liability for any loss or damage (whether direct or otherwise) a person suffers because that person has directly or indirectly used or relied on any information available on or via the Website. However, these Terms are to be read subject to any legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, conditions or obligations. If such legislation applies, to the extent possible, we limit our liability in respect of any claim to, at our option to the supply of our services again or the payment of the cost of having the services supplied again.

    • 7.3

      You are liable to us for breach of contract or negligence under the principles applied by the courts. However, you are not liable to us for any loss to the extent that it is caused by our negligence. You agree to indemnify us for all losses we directly or indirectly sustain or incur as a result of any breach by you of our (or our licensors’) intellectual property rights connected with your use of the Website.

  8. Termination and suspension
    • 8.1

      We may suspend, terminate or limit your access to the Website at any time with or without notice, including (without limitation) if:

      1. we reasonably believe that there is a real risk of loss or damage to us or another if we do not suspend, terminate or limit your access to the Website;
      2. the law requires us to do so;
      3. we believe on reasonable grounds that providing you with access to the Website is illegal or may become illegal;
      4. there is an emergency;
      5. if it is necessary for maintenance or repair of relevant equipment or systems; or
      6. if there are other reasonable grounds for us to do so.
    • 8.2

      We reserve the right to at any time with or without notice, and without any liability to you, modify or discontinue all or parts of the Website.

    • 8.3

      While we encourage you to complete all modules on the Website, you may cease using the Website at any time.

  9. Security
    • 9.1

      Communications between the Website and web browsers of viewers of the Website are protected by SSL encryption and Website content is hosted on servers within Australia.

    • 9.2

      However, the Website is subject to security risks inherent in any Internet service. Whilst we use reasonable endeavours to ensure that your personal information is secure, it is not possible to safeguard against all breaches of security. You are advised to ensure that the computer terminal from which you send email and messages from is secure.

  10. Privacy and confidentiality
    • 10.1

      We and/or people authorised by us may gather and process the information:

      1. which you may provide when accessing and using the Website, such as your name, address, email address, responses to health-related questions and other personal information about you; and
      2. regarding the way in which you use the Website including, without limitation, information acquired through the use of “cookies” programmed during the accessing of the Website.
    • 10.2

      The Website is still in development phase and is part of an active research trial. All information you submit via the website is treated confidentiality by us in accordance with our research participant information and consent form. It may be used in a de-identified fashion for research reporting, research collaboration and academic publication, but results will not contain material capable of personally identifying you. Please refer to your participant information and consent forms for further information, or contact us if you have any concerns.

    • 10.3

      You consent to us contacting you from time to time to ensure your personal information is current, to follow up on your progress with Website modules, to obtain your feedback about the Website and to check on your wellbeing related to the tasks completed by you on the Website.

    • 10.4

      If you submit any information to the Website that indicates you may be at risk of harming yourself or others, we may need to contact you and will use every reasonable effort to do so. This contact may be a telephone call to the phone number you have provided us. Due to the staffing arrangements we may not be in a position to be immediately aware of or respond to your crisis. If you are in a crisis situation, you should seek immediate help. You are also welcome to contact us.

    • 10.5

      We reserve the right to report to the relevant authorities, giving your personal details, situations where you or someone connected with you may be at risk of harm or committing a criminal act.

    • 10.6

  11. General

    • 11.1

      We may change the Terms at any time by posting the changed Terms on the Website. Amendments will be effective immediately upon notification on the Site. Your continued use of the Website following such notification will represent an agreement by you to be bound by the Terms as amended.

    • 11.2

      If any of these Terms are invalid, unenforceable or illegal, that term will be struck out and the remaining terms will remain in force.

    • 11.3

      If we do not act in relation to a particular breach by you of these Terms, this will not be treated as a waiver by us of our right to act with respect to subsequent or similar breaches. If you do not act in relation to a particular breach by us of these Terms, this will not be treated as a waiver by you of your right to act with respect to subsequent or similar breaches.

    • 11.4

      These Terms (and your dealings with us) are subject to the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of that State.
